These provisions apply to the LavishCars.com online marketplace and related services. Please read them together with our other applicable policies and any booking-specific Rental Provider agreement. Nothing in these policies removes rights that cannot legally be excluded.
Privacy and Marketplace Notice
LavishCars operates an online car rental marketplace. We process information to connect customers with independent Rental Providers and support inquiries, bookings, payments, communications and Platform security. This Policy describes how information is collected, used, disclosed and protected.
1. Our Marketplace Role
Relevant customer information may be shared with the Rental Provider to respond to inquiries, verify eligibility, prepare agreements and fulfil rentals. Providers may independently determine their own legally permitted uses and have their own privacy notices.
2. Information You Provide
We may collect names, contact details, WhatsApp numbers, location preferences, rental dates, vehicle choices, inquiry messages, account details, driving eligibility and identity information where needed, payment-related information, support records and voluntarily supplied information.
3. Information Needed by Providers
Providers may require licence, passport, national ID, International Driving Permit, age verification, card or deposit information. Such data may be given directly to the Provider or securely passed through LavishCars when necessary.
4. Information Collected Automatically
We may collect IP address, device and browser data, operating system, visited pages, referral source, interaction and approximate IP-based location, cookies and similar identifiers.
5. How We Use Information
We use information to operate the marketplace, respond to inquiries, connect users with Providers, arrange reservations and payments, provide support, investigate complaints, prevent fraud, secure systems, analyse performance, meet legal duties and send marketing where lawful.
6. Sharing With Rental Providers
We may share customer names, phone numbers, email, requested vehicle, rental dates, pickup or delivery details and necessary eligibility information with the relevant Provider for inquiry or rental fulfilment.
7. Independent Provider Processing
Providers may process received information under their own legal responsibilities. LavishCars does not control every independent Provider processing activity but may act against misuse under marketplace rules.
8. Service Providers
Hosting, cloud, communications, analytics, payment, security and support vendors may process information to provide contracted services, subject to applicable safeguards.
9. Payments
Third-party payment processors may handle card and transaction details under their own policies. LavishCars generally does not need to retain complete card numbers processed directly by those providers.
10. Legal and Regulatory Disclosures
Information may be disclosed when legally required or reasonably necessary to investigate fraud, protect safety and security, enforce rights or respond to lawful government and court requests.
11. Insurance, Claims and Incidents
Relevant data may be shared with Providers, insurers, claims administrators, legal advisers, police or authorities when necessary for accidents, damage or disputes.
12. Sale and Sharing of Personal Information
LavishCars does not sell customer information for monetary consideration as an ordinary business practice. Some privacy laws define advertising-related ‘sharing’ or ‘sale’ more broadly; applicable notices and opt-out rights will be respected.
13. SMS and Mobile Opt-In Information
Mobile numbers and SMS opt-in/consent information are not sold or shared with unrelated third parties for their own marketing. Messaging service providers may process them solely to deliver authorised messages.
14. SMS Communications
Where legally authorised, messages may concern inquiries, bookings, delivery and support. Frequency varies; carrier rates may apply. Reply STOP or HELP where supported. Marketing consent is not a condition of purchase.
15. WhatsApp and Other Messaging
Third-party messaging platforms process information under their own policies. LavishCars may retain relevant conversations for fulfilment, support, disputes, fraud prevention and compliance.
16. Cookies
We use necessary cookies and may use analytics and advertising cookies, subject to consent and opt-out requirements. Browser and available consent controls may limit cookies, sometimes affecting functionality.
17. Analytics and Advertising
We may measure website use, search activity, advertising performance and conversions using third-party tools, subject to applicable privacy and consent laws.
18. Marketplace Analytics
We may analyse searches, inquiries, vehicle demand, supplier performance and conversions, including through aggregated or de-identified reports where appropriate.
19. Data Security
We use reasonable technical, organisational and administrative safeguards against unauthorised access, loss, misuse and alteration, though no online system is completely secure.
20. Access Controls
Access is limited to authorised staff, Providers and service providers with a legitimate need, subject to applicable safeguards.
21. Retention
Information is kept only as long as reasonably needed for inquiries, bookings, support, payment, fraud prevention, accounting, tax, legal claims and compliance, then deleted or de-identified where appropriate. Specific periods depend on category and applicable law.
22. International Transfers
Data may be transferred or accessed across countries where LavishCars, Providers or technology vendors operate. Required transfer safeguards will be applied under applicable law.
23. Business Transfers
Data may be transferred as legally permitted during mergers, acquisitions, financing, restructuring or asset sales, subject to safeguards and communications-consent restrictions.
24. Privacy Rights
Depending on applicable law, users may have rights to access, correct, delete, restrict, object, withdraw consent, request portability and opt out of certain advertising-related processing.
25. Exercising Rights
Email info@lavishcars.com. We may verify identity and will respond within applicable legal deadlines. Some requests may be limited by lawful retention or other exceptions.
26. Marketing Preferences
Use unsubscribe links, STOP where supported, or contact us to withdraw marketing consent. Necessary transactional communications may continue where legally permitted.
27. Children
The rental marketplace is intended for adults. We do not knowingly solicit children’s personal data and will address improper collection in accordance with law.
28. Third-Party Websites
External Provider, payment, social media and other websites operate under their own privacy practices. Review their notices before sharing data.
29. Provider Misuse of Data
Providers should use customer information only for lawful, legitimate rental and service purposes. LavishCars may restrict or remove Providers that misuse data.
30. Fraud and Security
We may process relevant information to identify suspicious bookings, prevent fraud and unauthorised access, investigate abuse and enforce marketplace rules.
31. Automated Processing
Automated tools may assist fraud detection, lead routing, ranking, analytics and recommendations. Applicable rights regarding significant automated decisions will be respected.
32. Privacy Complaints
Contact info@lavishcars.com with concerns. Users may also have the right to complain to a relevant data-protection authority.
33. Data Breaches
We investigate, contain and remediate personal-data incidents and notify regulators or affected individuals when and within the period required by applicable law.
34. Policy Changes
This Policy may change with services, technology or legal requirements. Updates will show a revised date and be communicated where required.
